About these terms

rocketair.com is operated by RocketAir LLC, a New York limited liability company (“RocketAir,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) apply to your access to and use of rocketair.com and any page that links to these Terms (together, the “Site”).

Our Privacy Policy explains how we handle personal information, and forms part of these Terms.

Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they last changed. If you keep using the Site after a change takes effect, you accept the updated Terms.

Using the Site

You may browse the Site and use its content for your own informational, non-commercial purposes. You agree not to:

• Copy, republish, sell, or otherwise exploit any part of the Site, except as these Terms allow.
• Use the Site in a way that is unlawful, misleading, or harmful, or that infringes anyone’s rights.
• Interfere with the Site’s operation or security, including by introducing malicious code, probing for vulnerabilities, or overloading our systems.
• Use robots, scrapers, or other automated means to collect content or data from the Site, including to train artificial intelligence or machine-learning models, without our written permission.
• Impersonate anyone or misrepresent your connection with anyone, including RocketAir.
• Frame or mirror the Site, or remove any copyright or other notices from it.

Intellectual property

The Site and everything on it, including text, graphics, illustrations, animation, video, code, and logos, and the selection and arrangement of all of it, is owned by RocketAir or its licensors and protected by copyright, trademark, and other laws. We reserve all rights not expressly granted in these Terms.

RocketAir, the RocketAir logo, Win by Design™, and our other names and marks are trademarks of RocketAir LLC. You may not use them without our prior written permission.

The work we show was created for our clients and appears with their permission. Client names, logos, and trademarks belong to their owners, and showing them does not mean a client endorses anything beyond our work together.

Your submissions

When you send us information through the Site, such as a project inquiry, an application, or a message, you confirm that it is accurate and that you have the right to share it. We handle any personal information in it as described in our Privacy Policy.

Please don’t send us confidential information or unsolicited ideas, concepts, or proposals through the Site. Unless we have agreed otherwise in writing, anything you send is not confidential, and RocketAir remains free to develop similar ideas independently, with no obligation to you. If you’d like to share something confidential, ask us first and we can put a nondisclosure agreement in place.

Client work

Nothing on the Site is an offer to provide services. Every engagement with RocketAir is governed by a separate written agreement, which takes precedence over these Terms for that engagement. Descriptions of past work and results illustrate what we have done; they are not a promise of any particular outcome.

Other websites

The Site may link to websites, platforms, and content owned by others. We don’t control them and aren’t responsible for their content, policies, or practices. You use them at your own risk and under their terms.

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, RocketAir disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Site will be uninterrupted, secure, or error-free, or that its content is complete, accurate, or current. Content on the Site is general information, not professional advice.

Limitation of liability

To the fullest extent the law allows, RocketAir and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site, even if we have been told such damages are possible. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100).

Some jurisdictions don’t allow certain of these limitations, so some of them may not apply to you.

Indemnification

You agree to indemnify and hold harmless RocketAir and its members, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought only in the state or federal courts located in New York County, New York, and you consent to their personal jurisdiction.

General

• These Terms, together with our Privacy Policy, are the entire agreement between you and RocketAir about the Site.
• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we don’t enforce a provision, that is not a waiver of our right to do so later.
• You may not transfer these Terms. We may transfer them in connection with a merger, acquisition, or sale of assets.
• We may change, suspend, or end access to the Site at any time.
